Upper Tribunal allows students appeal in ETS TOEIC fraud case

Politics.co.uk says this was used to justify thousands of deportations as the Home Office claimed that everyone who had taken the TOEIC test conducted by ETS had committed fraud. The Financial Times reported that it is not clear how many people were deported, but more than 30,000 test scores were considered suspect.



As part of the investigation announced by the Minister for Immigration and Security on 24 June 2014, the Home Secretary ("SSHD") revoked the sponsor licence of City of London Academy ("CLA") and cited four grounds for doing so:

Use authentic texts to learn and practice the reading strategies.
Use TOEIC preparatory texts to practice the reading strategies under test conditions.
Think about the text-type of a given text.
Think about where a given text is used (social and situational contexts).
Think about the purpose of a given text.
Think about the main point(s) of a given text.
Think about the writer and/or source of a given text.
Think about the audience of a given text.
Think about the written expression of a given text.

It is highly suggested that learners first learn the strategies with very straightforward text-types such as forms and tables and gradually work up to the more difficult text-types categories such as letters and miscellaneous reading passages.

Tier 4 sponsors, regardless of whether or not they have been directly caught up in the TOEIC fraud investigation and/or have been asked by UKVI to withdraw sponsorship from students, must take their obligations in assessing English language seriously. Sponsors that fail to carry out thorough assessments risk being unable to mount a defence against an accusation that they present a serious threat to immigration control.

We are aware that a number of Tier 4 sponsors caught up in the TOEIC fraud investigation have also been accused of breaching their Tier 2 obligations and/or having weak processes in place concerning the rules on academic progression and/or having deficient attendance monitoring processes in place. Whilst it is extremely unlikely that SSHD would agree with Mr Justice Mostyn’s comments that it would be ‘a grossly disproportionate response’ to revoke a licence solely due to grounds (ii) to (iv), these comments may very well instil confidence in any sponsor that has its licence revoked on these grounds and seeks to challenge that decision in the future.

The best way to start is to download the TOEIC Examinee Handbook and try to read it up to page 7. Then stop! (Otherwise you’ll accidentally read printed transcripts of the audio questions of the online sample test provided by ETS).

"If you want to take any kind of test, make sure that you have enough time to prepare for it. I usually try to prepare myself at least two months prior to the test just to allow myself to get used to the test and to study for the test."

Also, some reading questions will use many different business communication methods (e-mails, newsletters, etc.) that are connected together. This will test your ability to find, gather and understand information from different sources.

The Seminar ended with enjoyment and good impression from the students at Thang Long University. It once again affirmed the determination of the school to integrate MOS into the school’s academic disciplines to enhance students’ IT proficiency up to international standards. As shared by the School Management Board, training students was not just limited to satisfying local recruiters but also for a broader ASEAN labor market, which will be integrated soon in 2015.

"Practice Effects" are real and scientifically proven: the second time you do something, you become better at it. Take a test once, and then take a similar one sometime later. Chances are very good that you’ll improve just because you’re now familiar with the technique of test-taking, even if you don’t do anything else to prepare for the second test.
