The Appellants, both nationals of Pakistan had made applications to extend their student visas prior to the expiration of their leave. The Secretary of State refused their applications and invalidated their existing leave by service of removal decisions under section 10 of the Immigration and Asylum Act 1999. Both Appellants lodged judicial review claims challenging the removal decisions.

The TOEIC test is becoming more and more popular in South East Asia. Each year, businessmen spend thousands of dollars to prepare for the TOEIC test with the hope of achieving more than 900 points, because they consider this as a key to success in the international business environment. Consequently, studying and preparing for TOEIC is a growing trend for students and employees in South East Asia countries. At the tribunal’s judgement, President Honourable Mr Justice McCloskey, said: "The evidence adduced on behalf of the Secretary of State emerged paled and heavily weakened by the examination to which it was subjected."

According to Mr. Doan Hong Nam, President of IIG Vietnam, "Vietnam was chosen to host this important event of the region because Vietnam had remarkable contributions to the development of TOEIC worldwide. Moreover, as the country representative of ETS in Vietnam, IIG has been doing a great job in training and expanding the number of TOEIC trainers". In addition, Vietnam has 7 teachers chosen by ETS to participate in the workshop with other teachers from the Philippines, Cambodia, Laos and Israel.

The tribunal also found there was no evidence from any English Testing Service (ETS) witness - the US firm behind the test which was contracted by the Home Office. The president said: "Almost remarkably, ETS provided no evidence, directly or indirectly, to this tribunal," further labelling the firm’s actions as "mildly astonishing."

The Court held that section 4 of the 1971 Act explicitly provides that the power to give or vary leave shall be exercised by notice in writing. The fact that the Secretary of State may have made the decision to refuse the application on 7 July 2014 was not relevant. What was legally relevant was the date and time of service of the notice.

The Court referred to R (Anwar and Adjo) v Secretary of State for the Home Department [2010] EWCA Civ 1275 where the words ‘stifle an appeal’ were used but distinguished that case to that of the Appellants on the basis that here, there were no findings of facts made by the tribunal and the Secretary of State was not trying to re-litigate a matter after losing an appeal.

Test Content
In the TOEFL, the test-taker is measured on his ability to function in an academic environment. In this regard, the vocabulary on this test is academic in nature and is similar to the vocabulary used in college text books. The topics of the reading and listening passages are similarly academic. You may read a passage on bird migration, for example, or listen to a lecture from an economics course. The TOEIC, on the other hand, measures the test-taker's ability to function in a business environment. Topics may range from dining out in a restaurant to presenting in a budget meeting.

Shortly after, in June 2014, Immigration Minister James Brokenshire made a statement to Parliament in which he said an investigation post-Panorama found evidence of 46,000 "invalid and questionable" tests.

Mr. Ali applied to vary his leave on 29 December 2013. A decision was made to remove him on the basis that he had used deception in his application for variation of leave. It was alleged that his Test of English for International Communication (TOIEC) certificate issued by Educational Testing Services (ETS) was obtained by a proxy test taker.

Sequencing
It is highly suggested that learners first learn the strategies with very straightforward text-types such as forms and tables and gradually work up to the more difficult text-types categories such as letters and miscellaneous reading passages.

With respect to the ‘worthwhile’ evidence point in Mr. Ali’s case, the Court held that it could not be said that the Secretary of State had no worthwhile evidence to satisfy herself that this was an appropriate case to make a removal direction and that this amounted to a special or exceptional factor justifying judicial review proceedings. Lord Justice Beatson stated that the appeals system "specifically envisages that challenges to the factual accuracy of evidence take place through an out-of country appeal and the information which informed the Secretary of State’s decision as to the deception was put before Mr. Ali, albeit in the text of the refusal decision rather than the removal decision".
