We are aware that a number of Tier 4 sponsors caught up in the TOEIC fraud investigation have also been accused of breaching their Tier 2 obligations and/or having weak processes in place concerning the rules on academic progression and/or having deficient attendance monitoring processes in place. Whilst it is extremely unlikely that SSHD would agree with Mr Justice Mostyn’s comments that it would be ‘a grossly disproportionate response’ to revoke a licence solely due to grounds (ii) to (iv), these comments may very well instil confidence in any sponsor that has its licence revoked on these grounds and seeks to challenge that decision in the future.

The hearsay evidence of Ms Collings and Mr Millington, the two main witnesses relied on by the Secretary of State was inherently limited in that neither of these witnesses possessed any relevant qualifications, credentials or expertise in what is ultimately a scientific field - namely, voice recognition technology and techniques;
There was no evidence from ETS;
The evidence from expert Dr. Harrison was persuasive and remained unchallenged by the Secretary of State;
The Appellant’s themselves were found to be truthful.

A major difference between the TOEFL IBT and the IELTS is in the Speaking section. On the IELTS, you have a face-to-face interview with a certified examiner. On the TOEFL IBT, you listen to a situation and record your response using a computer.

With respect to the no alternative remedy question, Mr. Malik contended that if the section 10 removal decision invalidated the Appellants’ leave, they had no appeal against the refusal to vary their leave. Therefore even if the section 10 notices were successfully challenged in out-of country appeals, the refusal of the applications to vary would still stand unless they were set aside by judicial review proceedings. The Court held that section 4 of the 1971 Act explicitly provides that the power to give or vary leave shall be exercised by notice in writing.
